Introduction
These terms and conditions govern your use of our website; by using our website, you accept these terms and conditions in full. If you disagree with any part of these terms and conditions, do not use our website.
Intellectual property rights
Unless otherwise stated, we or our licensors own the intellectual property rights in the website and material on the website. Subject to the licence below, all our intellectual property rights are reserved.
Licence to use website
You may view, download for caching purposes only, and print pages from the website, provided that:
(a) you must not republish material from this website (including republication on another website), or reproduce or store material from this website in any public or private electronic retrieval system;
(b) you must not reproduce, duplicate, copy, sell, resell, visit, or otherwise exploit our website or material on our website for a commercial purpose, without our express written consent;
(c) you must not edit or otherwise modify any material on the website.
Cancellation Policy
By Customer (Customer is the person placing order for picnic(s) irrespective if they are ordered as a gift for another person):
Orders for picnics to be delivered at an event or collected by the Customer may only be cancelled by the Customer within 72 hours of placing an order. Notwithstanding the foregoing, if an order is received within 72 hours of the planned time for the event, the Customer may not cancel the order.
Once an order is received, the picnic(s) will be delivered to the location of the event at the stated time, irrespective of weather conditions or cancellation of event by event organiser.
In the event that a written request for a cancellation is received within the relevant period, a refund of the value of the picnics only (subject to any costs already incurred by The Social Picnic Company) will be made to the card from which payment was received. Under no circumstances will handling charges be refunded for orders cancelled by Customer.
All cancellation requests must be sent via email to events@thesocialpicnic.co.uk and must include the confirmation number(s) provided at the time of order. Acceptance of cancellation for any other reason is at the sole discretion of Directors of The Social Picnic Company.
By The Social Picnic Company
The Social Picnic Company reserves the right to cancel orders at any time with 72 hours’ notice to the Customer. The Social Picnic Company will contact the Customer via any of the contact methods (including email and telephone – leaving voice message where appropriate) recorded at time of order and provide a refund of the total amount paid at time of order including handling charges.
Amendments
- Customers can amend their order up to 48 hour’s grace period before delivery, after the time of booking.
Beyond this, The Social Picnic are unable to process:
- Changes to the delivery window or address selected at checkout or at the point of invoice being issued
- Cancellations
- A reduction to or removal of any items from the order
We will do our best to accommodate any last-minute product additions to your order based on our availability. Please get in touch as soon as possible at orders@thesocialpicnic.co.uk.
Allergens and Dietary Requirements
Products may contain allergens; please always refer to product descriptions. Customers must disclose all dietary restrictions or allergies at the time of placing the order. The Social Picnic will make reasonable efforts to accommodate dietary requests but cannot guarantee allergen-free products. The Social Picnic is not liable for any allergic reactions arising from undisclosed dietary requirements
Catering & Hamper Deliveries
Payment is required in full ahead of the delivery date to secure the booking unless other terms are agreed or you have an account with Pique. Failure to pay by the agreed due date gives Social Picnic the right to charge interest at the current rate of the Bank of England. Payment or written confirmation of your order constitutes acceptance of these Terms and forms part of the binding Agreement. Clients are responsible for providing the correct delivery address and ensuring someone is available to receive the delivery.
Group Picnics
On acceptance of your quote for catering services, a 20% non-refundable deposit of the total cost is required to secure the booking.
Cancellations:
- 20% of total cost if cancelled 7 days prior to Event date
- 50% of total cost if cancelled 4 days prior to Event date
- 100% of total cost if cancelled 48 hours prior to Event date
Reduction in numbers: We understand that it is not always possible to know how many people will actually come to your event. However, we cannot accept a reduction in numbers within 7 days of the Event date.
Events booked on days listed as Public Holidays will incur a 20% increase on the total bill.
Faulty, damaged, incorrect or missing products
It is solely the responsibility of the customer to open and check all products received strictly at the point of delivery or collection. It is therefore the responsibility of the individual who has made the order to be present to receive or collect it.
Once products are received and accepted (once above checks have been made) at the point of delivery or collection, orders will be classed as fully ‘accepted’ by the customer. If orders are not checked at the point of delivery or collection, orders will still be classed as ‘accepted’ by the customer. By ‘accepting’ an order from The Social Picnic, the responsibility of the products thereafter is solely with the customer.
Should there be a faulty or damaged item, we must be informed strictly at the point of delivery or collection, before an order is ‘accepted’, in order to offer a solution, if the fault lies with The Social Picnic. Images of faulty or damaged items will be required in order to offer a solution.
Should there be a faulty or damaged item brought to our attention after an order is ‘accepted’, The Social Picnic will not be held responsible or able to offer a solution.
Delivery by Courier or 3rd party carrier
UK shipping is available for select products using an overnight courier service – usually DPD.
We book a ‘next day’ delivery service with our provider DPD & the success rate is usually c.95-98%. A parcel not being delivered, as booked, the ‘next day’ can be due to a number of reasons such as hub/driver capacity, processing hub issues/delays, adverse weather issues, local disruptions etc. These issues are not only completely out of The Social Picnic’s control, but as a business we are not forewarned.
The Social Picnic are not responsible to ensure that parcels arrive on time – this lies solely with the courier provider (in this case DPD).
Customers are to always accept a ‘late’ delivery & contact The Social Picnic immediately with details of the late order, if there is a problem with any element of the product. After an investigation, a solution will be provided if required.
Health and Safety
The Social Picnic adheres to strict food safety and hygiene standards. The Social Picnic is not liable for issues caused by mishandling food after delivery. The customer is responsible for providing a safe and clean environment for storage of food once delivered and used within the 48-hour window of delivery. The Social Picnic may refuse service if conditions are unsafe.
Social Media
Unless our clients/customers explicitly ask us not to use images taken at their event, we reserve the right to use them on our social media platforms.
Gift Vouchers
The Social Picnic will hold gift card voucher credit for a maximum of one year from the date of purchase, unless otherwise specified.
Gift cards are only redeemable on the Social Picnic website.
Gift cards cannot be exchanged or be redeemed for cash and are strictly non-refundable and non-transferable. They also cannot be replaced if lost or stolen.
Where goods you have purchased with a gift voucher are subsequently exchanged for goods of a lower price or returned, monies owing will be refunded to the same gift voucher code.
We reserve the right to refuse to accept a gift voucher which we deem to be tampered with, duplicated or which otherwise is suspected to be affected by fraud.
We reserve the right to amend the gift voucher terms and conditions from time to time, where we consider it reasonable and necessary to do so.
Unless specified, the cost of delivering a recipient’s picnic is not included.
All other The Social Picnic Company terms and conditions apply.
Force Majeure
If due to war, strikes, industrial action short of a strike, lockouts, accidents, fires, blockades, import or export, embargos, ice, obstructions, natural catastrophes, government interventions, national or local disasters,terrorism or other such events beyond the control of The Social Picnic Company, including the cancellation of any event or concert by an event organiser, The Social Picnic Company is unable to perform its obligations and will be under no liability to the customer for any loss or damages which may be incurred by the customer.
Limitations of liability
The information on this website is provided free-of-charge, and you acknowledge that it would be unreasonable to hold us liable in respect of this website and the information on this website.
Whilst we endeavour to ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we not commit to ensuring that the website remains available or that the material on this website is kept up-to-date.
To the maximum extent permitted by applicable law we exclude all representations, warranties and conditions (including, without limitation, the conditions implied by law of satisfactory quality, fitness for purpose and the use of reasonable care and skill).
Our liability is limited and excluded to the maximum extent permitted under applicable law. We will not be liable for any direct, indirect or consequential loss or damage arising under these terms and conditions or in connection with our website, whether arising in tort, contract, or otherwise – including, without limitation, any loss of profit, contracts, business, goodwill, data, income, revenue or anticipated savings.
However, nothing in these terms and conditions shall exclude or limit our liability for fraud, for death or personal injury caused by our negligence, or for any other liability which cannot be excluded or limited under applicable law.
Restricted access
Access to certain areas of our website is restricted. We reserve the right to restrict access to other areas of our website, or indeed our whole website, at our discretion.
Variation
We may revise these terms and conditions from time to time. Please check this page regularly to ensure you are familiar with the current version.
Entire agreement
These terms and conditions, together with our privacy policy constitute the entire agreement between you and us in relation to your use of our website, and supersede all previous agreements in respect of your use of this website.
Law and jurisdiction
This notice will be governed by and construed in accordance with English law, and any disputes relating to this notice shall be subject to the exclusive jurisdiction of the courts of England.
Complaints
Any complaint shall be made promptly and in any event must be received at the company’s office in writing addressed to the Managing Director, not more than 24hrs from the date of the event concerned. We cannot accept complaints after this time.
